The Court of Appeal yesterday fixed the Revision Application filed by the Samagi Jana Balawegaya (SJB) requesting to invalidate the injunction issued by the Colombo District Court preventing the party from removing SJB Gampaha District MP Field Marshal Sarath Fonseka as the Chairman of the party and the Organiser of the Kelaniya electorate, for support on May 21.
The petition has been filed by the officer-bearers of the party including the leader of the party and Opposition Leader Sajith Premadasa and party’s General Secretary MP Ranjith Madduma Bandara, naming MP Sarath Fonseka as the respondent.
Upon considering a petition filed by MP Fonseka, the District Court issued the injunction in question on February 19 and it was extended later despite the preliminary objections raised by the SJB against it.
The revision petition in the Court of Appeal was considered yesterday before Justice D.N. Samarakoon.
Attorney-at-Law Jesika Nimali Abeyratne instructed by Dr. Romesh de Silva, PC, appeared for the SJB while Faizer Musthapa, PC, appeared for MP Sarath Fonseka.
