AG raises objections to granting bail to suspects

The Attorney General (AG) yesterday raised objections before the Court of Appeal against the granting of bail to suspected SSP K.B.Keerthiratne and the three  Police Constables who have been remanded in connection with the shooting to death of a man during a protest in Rambukkana demanding petrol.

Deputy Solicitor General Janaka Bandara who appeared on behalf of the Attorney General informed this when a Writ Petition which was filed seeking an annulment of the order issued by the Kegalle Magistrate remanding the suspects, was taken up before the Court of Appeal yesterday.

The petition was taken up before a Bench of Justices Sobhitha Rajakaruna and Dhammika Ganepola.

President’s Counsel Shavindra Fernando appearing for the petitioners, said that he was ready to withdraw the Writ Petition if the Attorney General did not object to the granting of bail to the suspects.

Responding to that, Deputy Solicitor General Janaka Bandara said that further investigations are being carried out into the incident.

He further stated that the Attorney General opposes a request for the granting of bail to the suspects in this case.

Accordingly, Shavindra Fernando PC said that they expected to make submissions regarding the obtaining of the interim order sought by the petitioners.

The petition will be taken up again for further consideration on June 29. Senior Superintendent of Police K.B. Keerthiratne and three Police Constables have filed the Writ Petition.

Chaminda Lakshan, a father of two, was shot to death by Police during a protest rally in Rambukkana demanding for petrol on April 19.

The Kegalle Magistrate on April 27 ordered the arrest of the suspects who ordered the shooting and carried out the shooting.

The petition states that the order issued by the Kegalle Magistrate’s Court ordering the arrest of the suspects is legally flawed.

Therefore, the petitioners contend that the remand order issued against them after they were produced before the Court is also not in accordance with the law.

It also states that it is unfair to have remanded them for more than a month while the investigation into this incident has not been completed. Therefore, the petition seeks a Writ Order nullifying the order issued by the Magistrate Court.

President’s Counsels Rienzie Arsakularatne and Upul Jayasuriya appeared for the aggrieved parties.
