SC directs serve notices on IGP and former Defence Secretary

The Supreme Court directed the petitioner to serve notices on IGP Pujith Jayasundara, former Defence Secretary Hemasiri Fernando in connection with a Fundamental Rights petition filed by a father of two deceased children who died during Easter Sunday attack.

The petitioner Saman Nandana Sirimanne, the father of late Medha Sathsarani Sirimanne, 21, and late Imesh Thiwanka Sirimanne, 19, who met an untimely death at the explosion that took place on the April 22, 2019 at Shrine of St. Anthony Church, Kochchikade filed this FR petition seeking an order to investigate and prosecute the Inspector General of Police and former Defence Secretary under Penal Code.

When the petition came up before Supreme Court three-judge-bench comprising Justice Prasanna Jayawardena, Justice Murdu Fernando and Justice E.A.G.A. Amarasekera, neither the IGP Pujith Jayasundara nor the former Defence Secretary Hemasiri Fernando were represented by an attorney.

Counsel who represents the Attorney General informed court that his Department has taken a decision not to appear on behalf of both IGP and former Defence Secretary. Accordingly, the petition was fixed for support on May 21.
