New Bench to hear former MSD director, Keheliya’s remand challenge case on May 30, 31

A new Bench presided by Court of Appeal President Nissanka Bandula Karunaratne yesterday fixed the writ application filed by former Health Minister Keheliya Rambukwella challenging his arrest and remand by the Maligakanda Magistrate’s Court over the controversial substandard human immunoglobulin purchase case, for support on May 31.  Rambukwella being the eighth accused of the case has been remanded by Magistrate Lochana Gamage until the final determination of the case.

The writ petition which was heard earlier before Court of Appeal Judge D.N. Samarakoon was referred to this new bench last week as Justice Samarakoon was due to retire in the same week.  Accordingly, the petition was considered before Justice Nissanka Bandula Karunaratne and B.Sasi Mahendran yesterday and was fixed for support.

Meanwhile, the same new Bench fixed the writ application filed by former Director of the Medical Supplies Division (MSD) Dr.Kapila Wickremanayake for argument on May 30.

Dr. Wickremanayake who is the second accused of the same case being heard before the Maligakanda Magistrate’s Court has filed this seperate Writ Application challenging his arrest and remand over the same case.

His petition on which the order was due to be delivered was also heard before Justice D.N.Samarakoon and the order was postponed on several occasions by the Court. Later, the petition was referred to the new Bench last week.  Both petitioners have named the Maligakanda Magistrate, the IGP, Director ClD and several other parties as respondents to the petitions. President’s Counsel Faisz Musthapha appeared for the former Minister while President’s Counsels Dr. Romesh de Silva and Sarath Jayamanna appeared for the former Director of the MSD in the Court of Appeal yesterday.

Deputy Solicitor General Lakmini Girihagama appeared for the Attorney General.
