Affidavit given to Court pledging no further action

President’s Counsel Rienzie Arsekularatne who appeared for Rev. Fr. Cyril Gamini yesterday gave an affidavit to the Court of Appeal pledging that no further action will be taken  regarding the complaint made to the Fort Magistrate’s Court against former President Maithripala Sirisena for failing to prevent the Easter Sunday attacks.

The President’s Counsel agreed to proceed in accordance with the affidavit until the hearing of the petition submitted by former President Maithripala Sirisena requesting that the summons issued by the Fort Magistrate’s Court be invalidated in relation to that complaint.

This pledge was given when the Writ Petition was summoned before the Appeal Court Bench consisting of Justice Sobitha Rajakaruna and Justice Dhammika Ganepola.

The Court of Appeal rejected a request made earlier by Rienzie Arsekularatne, PC to refer the matter to a fuller Bench to consider the legal matter that arose during the hearing of the petition.

It was further informed that if it is necessary to refer it to a full Bench, the request should be referred to the President of the Court of Appeal.
