Colombo HC to deliver order in Divi Neguma case today

The Colombo High Court is to deliver its order today (30) regarding an application filed on behalf of former Minister Basil Rajapaksa and three others requesting to acquit them from the Divi Neguma case, without calling defence evidence.

The former Minister and three others had filed this application through their lawyers on the basis that the prosecution evidence has failed to establish the Commission of the offence charges against the accused in the indictment.

This order will be delivered by High Court Judge R. Gurusinghe.

The Attorney General had filed indictments against former Minister Basil Rajapaksa, former Secretary to the Ministry of Economic Development Dr. Nihal Jayasinghe, former Director General of Divi Neguma Department Kithsiri Ranawaka and former Deputy Director General of Divi Neguma Department Bandula Tilllekasiri in the Colombo High Court for allegedly committing criminal breach of trust with regard to Rs.2,992 million while being utilized for the ‘Isurumath Niwahana’ programme during the January - 2015 Presidential election.

The defence had filed this application in terms of Section 200 (1) of the Code of Criminal Procedure requesting the Court to record a verdict of acquittal, on behalf of the first and fourth accused, in view of the fact that the evidence led by the Prosecution totally failed to establish the commission of the offence charged against the accused in the indictment.
