FR filed on behalf of Hizbullah fixed for September 23

A Fundamental Rights (FR) petition filed on behalf of Attorney-at-Law Hejaaz Hisbullah, who has been arrested by the Criminal Investigation Department (CID) over allegations of being linked with the Easter Sunday suicide bombers, was yesterday fixed for further submissions on September 23 by the Supreme Court.

The court was informed that a magisterial inquiry against Hisbullah was to be taken up at the Colombo Fort Magistrate’s Court, yesterday.

Attorney-at-Law Gowry Shangary Thavarasha had filed the petition, seeking an Interim Order directing the release of Hizbullah from custody.

The Petitioner is further seeking an Interim Order suspending the operation of the purported Detention Order pending the final hearing and determination of this application.

The Petitioner has further sought an Interim Order to immediately produce Attorney-at-Law Hizbullah before the relevant Magistrate’s Court.

The Petitioner stated that contrary to law, Hizbullah has not been produced before a Magistrate since his arrest, and that despite him being arrested on April 14, a copy of the purported Detention Order was said to have been handed over to him on April 25.

At a previous occasion, the father and wife of Hejaaz Hizbullah had also filed two separate Habeas Corpus petitions in the Court of Appeal demanding his release.

Faisz Musthapha PC with Ikram Mohamed (PC), Saliya Pieris (PC), Senior Counsel Viran Corea, Counsel Niran Anketell and Counsel Hafeel Farisz appeared on behalf of the petitioner.

Senior Deputy Solicitor-General Nerin Pulle, with Senior State Counsel Dr. Avanti Perera, appeared on behalf of the CID and the Attorney-General. Shammil Perera (PC) and Manohara de Silva (PC) appeared for the intervenient petitioners.
