Bail application to be heard on Feb 17

Former State Timber Corporation (STC) Chairman Piyadasa Dissanayaka who were sentenced to 12-years’ rigorous imprisonment for soliciting and accepting a bribe have filed for bail pending appeal before the Permanent High Court Trial-at-Bar. This application is to be taken up for inquiry on February 17 by the Trial-at-Bar bench.

Former State Timber Corporation (STC) Chairman Piyadasa Dissanayaka who was found guilty for soliciting a bribe from an Indian investor who wished to acquire a section of the Kantale sugar factory was sentenced to 12 years’ rigorous imprisonment with a fine of Rs. 55,000 by the Permanent High Court Trial-at-Bar, on December 19, 2019.

The bail application was taken up yesterday before the Trial-at-Bar bench comprising High Court Judges Sampath Abeykoon (President), Sampath Wijeratne and Champa Janaki Rajaratne.

The bail application was filed by President's Counsel Gamini Marapana appearing for Piyadasa Dissanayaka. Defence counsel informed the court that they have filed papers relating to an appeal before the Supreme Court challenging Piyadasa Dissanayaka’s imprisonment. Counsel has asked court to issue an order for his client to be released on bail until the appeal is heard and a final verdict is given by the Supreme Court.

Senior State Counsel Janaka Banadara who appeared on behalf of the Attorney General informed the court that they expect to raise objections against this bail application.

Accordingly, the Attorney General was ordered to present his objections before February 3 and the defence counsel was ordered to present his counter-objections on or before the February 10.

The bail application will be taken up again on February 17 for inquiry.

The two accused, former President Maithripala Sirisena's former Chief of Staff Kusumdasa Mahanama and former State Timber Corporation (STC) Chairman Piyadasa Dissanayaka were arrested by officers of the Commission to Investigate Bribery or Corruption (CIABOC) in the car park of a luxury hotel in Colombo on May 3, 2018, while they were allegedly accepting a bribe of Rs. 20 million.
