Case filed against four accused for planning to assassinate former President fixed for July 6

The case filed against four accused including former Gampaha Superintendent of Police Lakshman Cooray, who allegedly planned to assassinate former President Mahinda Rajapaksa during an election rally in Kurunegala, was fixed for July 6 to deliver its order regarding the maintainability by the Colombo High Court.

The case was taken up before Colombo High Court Judge Mahesh Weeraman. Attorney-at-Law Gamini Alwis appearing for accused Lakshman Cooray had raised preliminary objections stating that the case cannot be pursued based on the evidence led by the prosecution.

At a time when the High Court has refused to accept a confession by the second accused as evidence, this Preliminary objection was made that it is not possible to present the same confession as evidence in this case.

The Attorney General yesterday produced counter objections over the relevant preliminary objection by the defence.

After considering the circumstances, the case was fixed for July 6 to deliver its order regarding the maintainability of the case by the Colombo High Court.

The Attorney General had filed indictment under the Prevention of Terrorism Act (PTA) against four accused including former Gampaha Superintendent of Police Lakshman Cooray for planning to assassinate the former President at a public rally in Maligapitiya, Kurunegala on February 7, 2009.

The other accused are Selvaraja Kirubakaran, Nadesan Tuhiya Nagan and Thangavelu Nimalan.
