A Writ Petition which was filed by Senior Superintendent of Police K.B.Keerthiratne and three Police Constables seeking an annulment of the order issued by the Kegalle Magistrate to remand them in connection with the shooting to death of a man during a protest in Rambukkana was withdrawn yesterday at the Court of Appeal.
This was stated when a petition filed seeking the issuing of an Interim Order suspending the order given by the Kegalle Magistrate to remand the suspects was taken up before the Court yesterday.
The petition was taken up before the Court of Appeal Bench comprising Justices Sobitha Rajakaruna and Dhammika Ganepola.
The Court of Appeal previously fixed to announce the order on August 30 on whether to issue an interim order or not regarding the matter.
However, the Kegalle High Court had recently filed a motion related to this petition to the extent that the group was ordered to be released on bail.
Accordingly, this petition was taken up yesterday and President’s Counsel Shavindra Fernando appearing for the petitioners sought from the Court to withdraw the petition.
Additional Solicitor General Vikum de Abrew, appearing on behalf of the Attorney General, stated that he would not object to it. Accordingly, the request was allowed by the Court. Senior Superintendent of Police K.B. Keerthiratne and three Police Constables have filed the Writ Petition.
Chaminda Lakshan, a father of two, was shot to death by Police during a protest rally in Rambukkana demanding for petrol on April 19.
The Kegalle Magistrate on April 27 ordered the arrest of the suspects who ordered the shooting and carried out the shooting.
The petition states that the order issued by the Kegalle Magistrate’s Court ordering the arrest of the suspects is legally flawed.
Therefore, the petitioners contend that the remand order issued against them after they were produced before the Court is also not in accordance with the law.
It also states that it is unfair to have been remanded for more than a month while the investigation into this incident has not been completed. Therefore, the petition seeks a Writ Order nullifying the order issued by the Magistrate’s Court. President’s Counsels Rienzie Arsakularatne and Upul Jayasuriya appeared for the aggrieved parties.
