Cremation of Muslim and Catholic COVID-19 dead: Petitions re-fixed for support

UPDATE: Twelve Fundamental Rights petitions filed seeking an order staying the operation of the gazette notification issued to cremate the corpses of Muslim and Roman Catholics persons who die of COVID-19 were yesterday re-fixed for support by the Supreme Court.

The Supreme Court three-judge-Bench comprising Justice Sisira de Abrew, Justice S. Thurairaja and Justice L.T.B. Dehideniya re-fixed the petitions to be taken up for support on November 26.

The court was informed that notices have to be sent to the newly appointed Director General of Health Services and Health Ministry Secretary who had been named as the respondents in the petition.

Petitioners including leader of Sri Lanka’s All Ceylon Makkal Congress (ACMC) Rishad Bathiudeen and several others have filed these petitions alleging that rules relating to dispose the bodies of suspected Muslim victims of COVID-19 are contrary to the method practiced by followers of Islamic Faith.

The petitioners have cited the Minister of Health, Nutrition and Indigenous Medicine, Director General of Health Services of the Ministry of Health and Indigenous Medical Services, Secretary of the Ministry of Health and Indigenous Medical Services, and the Attorney General as respondents.
