Shani Abeysekara withdraws first FR petition

Former CID Director Senior Superintendent of Police Shani Abeysekara withdrew the first Fundamental Rights petition he filed yesterday before the Supreme Court. Through this petition, Shani Abeysekara had challenged his transfer from the post of CID Director to a Personal Assistant to the Deputy Inspector General of Police of the Galle Range. Through his counsel, Shani Abeysekara sought Court's permission to withdraw the petition since he has already filed another Fundamental Rights petition challenging the National Police Commission's subsequent decision to interdict him from the police service.

The Supreme Court three-judge-bench comprising Justice Sisira de Abrew, Justice L.T.B. Dehideniya and Justice Preethi Padman Surasena allowed the petitioner to withdraw the petition and the petition was dismissed.

Petitioner Shani Abeysekara stated that the transfer was not routine, and he did not receive any prior notice of such transfer and no reason was given or stated. The petitioner further stated that through this arbitrary decision, he has been penalised without any lawful or justifiable cause, reason or justification. The petition had been filed through Attorney-at-Law Manjula Balasooriya and the petitioner has cited Acting inspector General of Police C.D. Wickramarathne, Inspector General of Police Pujith Jayasundara, Chairman, Secretary and six members of the National Police Commission, Chairman Mahinda Deshapriya and two members of Election Commission, CID Director W. Thilakarathna, Secretary of Ministry of Defence and the Attorney General as respondents.

A Fundamental Rights petition filed by former CID Director Senior Superintendent of Police Shani Abeysekara was today withdrawn by himself before Supreme Court.


Through this petition, Shani Abeysekara had challenged his transfer from the post of Director CID to a Personal Assistant to the Deputy Inspector General of Police of Galle Range.
