Writ petition of former Negombo Prison Superintendent to be considered on Monday

UPDATE: The writ application filed by former Negombo Prison Superintendent Anuruddha Sampayo seeking an order to stay the arrest warrant issued against him by Negombo Magistrate’s Court is to be considered by Court of Appeal on July 27.

Senior Deputy Solicitor General Milinda Gunatillake with Deputy Solicitor General Dileepa Peiris appearing for the Attorney General raised objections for the petitioner’s decision to file an amended petition after changing the prayers. The petitioner had filed an amended petition by adding a relief to quash the arrest warrant issued by Negombo Magistrate’s Court on July 22.

In his original petition, the petitioner sought an order to prevent him from being arrested by the CID.

Taking into consideration the facts, the Court of Appeal Bench comprising Justice (President) A.H.M.D. Nawaz and Justice Sobhitha Rajakaruna directed the petitioner to file a fresh application next Monday.

Filing this petition through President’s Counsel Upul Jayasuriya, the former Negombo Prison Superintendent stated that the CID is preparing to arrest him following an incident where a cell equipped with luxury utilities were discovered inside the Negombo prison.

In his petition, the former Negombo Prison Superintendent stated that the CID conducting investigations into the incident has already filed a ‘B’ Report against him at the Negombo Magistrate’s Court and measures are being taken to obtain a warrant for his arrest in an arbitrary manner contrary to the laws.

The petitioner stated that there are provisions in the Prison Ordinance to provide electronic equipment to the inmates after taking into consideration their requirements.

The petitioner has cited Commissioner General of Prison, CID Director, Justice Ministry Secretary, Attorney General and several others as respondents.
