Akila seeks dismissal of SJB case against UNP

United National Party (UNP) General Secretary Akila Viraj Kariyawasam who was named as a defendant in the case filed by Samagi Jana Balawegaya General Secretary Ranjith Maddumabandara seeking a restraining order preventing the decision of the UNP working Committee to expel Samagi Jana Balawegaya party representatives from the UNP, yesterday filed objections before the Colombo District Court seeking to dismiss the case.

On a previous occasion Colombo District Court Chief Judge Amali Ranaweera refused to issue a restraining order, deciding that it was appropriate to consider the submissions from both sides’ before issuing a restraining order against the parties’ ban letters and she ordered defendants to produce their written submissions on June 12.

Following the order, UNP General Secretary Akila Viraj Kariyawasam yesterday filed the objections before the Colombo District Court through the Vidanapathirana Law Firm and pointed out that the complainant had concealed factual information when filing the case.

In his objections, UNP General Secretary Kariyawasam noted that following the Presidential election 2020, the UNP Working Committee decided to contest the General election through an alliance and decided to appoint Sajith Premadasa as its leader and had also discussed the matters concerning the alliance’s constitution and the symbol.

However, several UNP Members registered a separate political party on March 4 named the ‘Samagi Jana Balawegaya’ with Sajith Premadasa as its leader and Ranjith Maddumabandara as its General Secretary.

Kariyawasam pointed out that the UNP had not allowed any party members to contest the General Election representing another party, adding that this move has violated the UNP’s Constitution.

He also noted that SJB General Secretary, Maddumabandara appears to have filed without cause of action and that it is in violation of Section 15, 16, 40 and 46(2) of the Civil Procedure Code. Accordingly, he seeks from the court to dismiss the case filed by SBJ General Secretary Bandara and to reject a restraining order against expulsion of SJB party representatives from the UNP.

The case was filed demanding a restraining order preventing the activation of letters of revocation of Samagi Jana Balawegaya party members from the UNP. UNP Leader Ranil Wickremesinghe, General Secretary Akila Viraj Kariyawasam and Deputy Leader Ravi Karunanayake were named as the accused in the case.

The case was yesterday taken up before Colombo Chief Judge Amali Ranaweera who ordered the defendants to produce their oral submissions on June 15 and the order will be delivered on the same day.
