AG validates Police actions on COVID-19

On the advice sought by Acting Inspector General of Police (IGP), Attorney General (AG) Dappula de Livera has approved the imposition of curfew and other measures taken to curb the spread of Covid-19 by Police.

Coordinating officer to Attorney General, State Counsel Nishara Jayaratne told Daily News that this decision has been made by the Attorney General after considering the letter dated April 30  sent by the Acting IGP.

Following the decision, the Attorney General mentioned in his letter that, after detecting the first person infected with the COVID-19 virus on March 11, The Director General of Health Service mandated acting IGP to take specific steps to prevent and control Covid-19 in the Country pointing out that the increase in the numbers of persons who may be infected with COVID-19 is foreseeable and that it would be extremely necessary that steps be taken to curtail the spread of the virus, which are also in step with World Health Organization (WHO) guidelines and similar measures followed in many other countries where the said disease was prevalent.

Further, he mentioned that the Regulations published under the Provisions under the Quarantine and Prevention of Diseases Ordinance, namely Regulations published in Gazette notification No.7481 dated 28.8.1925 and Gazette notification No.12125 dated 06.05.1960, has been amended by Gazette notifications dated March 20, 2020, published in Gazette Extraordinary No.2167/18, to declare Covid-19 as a quarantinable disease and in terms of Gazette notification dated March 25, 2020, published in Gazette Extraordinary No.2168/6, the Director General of Health Services has been designated as the “Proper Authority”.

Accordingly, the Director General of Health Services acting in the terms of Regulation 37 of the published in Gazette notification No.7481 dated 28.8.1925, as amended by the aforesaid Regulations, has delegated to the Acting IGP the powers to implement the said Regulations to control and prevent the disease Covid-19.

Accordingly, Attorney General has declared that the steps taken by the Police to control the COVID-19 outbreak including the imposition of the curfew are validated by the law and the measures implemented by the Police on the request of the Director General of Health Services, are measures deemed necessary to prevent and control the spread of COVID-19.
