Three judge CA bench to hear writ petitions filed by Ravi, others

The Court of Appeal yesterday decided to constitute a three-judge-bench to hear four writ petitions filed by former Finance Minister Ravi Karunanayake and others. They are seeking an Interim Order to stay arrest warrants issued against them by Colombo Fort Magistrate in connection with the issuance of Treasury Bonds in March 2016.

Accordingly, Court of Appeal three-judge-bench comprising Justice (President) A.H.M.D. Nawaz, Justice Shiran Gunaratne and Justice Sobhitha Rajakaruna fixed the petitions for support today (12).

Senior Deputy Solicitor General Milinda Gunatilleke appearing for the Attorney General moved court to constitute a three-judge-bench to hear these petitions since matter deals with substantial public interest. President’s Counsel Navin Marapana appearing for Arjuna Aloysius informed court that there is no constitutional provision for the request by the Attorney General who had made this request through a motion. However, taking into consideration the facts, Justice (President) A.H.M.D. Nawaz decided to appoint a three-judge-bench to hear these petitions. Meanwhile, the Attorney General yesterday raised preliminary objections challenging the maintainability of these petitions.

Senior Deputy Solicitor General Milinda Gunatilleke moved court not to issue notices against the respondents and he further requested to dismiss the petitions in limine.

In his petition, Ravi Karunanayake further sought a writ of prohibition restraining the Acting IGP and CID from executing the concerned arrest warrant. Ravi Karunanayake further sought a writ of certiorari quashing the instructions made by Attorney General to obtain arrest warrant against him on March 3.

In his petition, Ravi Karunanayake has named Attorney General, Acting IGP C.D. Wickramaratne, SSP Ampavila, Fort Magistrate Ranga Dissanayake and the OIC attached to the Financial Investigation Unit of CID as respondents.

He reiterates that Bond Commission appointed to investigate Treasury Bond issuance never questioned the petitioner regarding the meeting held on March 28, 2016 and March 30, 2016 and any alleged link between the said meetings and the lease of the apartment.
