Ajith Prasanna released on bail

Attorney-at-law Ajith Prasanna who was remanded over making contemptuous statements against the judiciary, was ordered to be released under strict bail conditions by the Colombo High Court on Wednesday.

The High Court decided to grant bail to the accused following his counsel’s undertaking that his client would not make any contemptuous remarks regarding the judiciary in the future.

Accordingly, Colombo High Court Judge Dhammika Ganepola imposed a bail condition ordering the accused not to make any statements to the media regarding ongoing court cases.

The judge also ordered the court registrar to take necessary measures to notify the heads of main media institutions regarding this bail condition.

The accused was ordered to be released on a cash bail of Rs.100,000 with two sureties of Rs. 500,000 each. The Colombo High Court also ordered the Director of the Criminal Investigations Department (CID) to monitor the conduct of the accused in order to ascertain whether he adheres to the bail conditions. The court further ordered the CID Director to immediately report to the court if he violates bail conditions.

On a previous occasion, the Colombo High Court ordered Ajith Prasanna to be remanded following an inquiry over contemptuous statements criticising Colombo High Court Judge Gihan Kulatunga at a press conference regarding an ongoing court case filed against former Magistrate Thilina Gamage on January 12, 2020.

When the case was taken up before Colombo High Court Judge Dhammika Ganepola, President’s Counsel Maithri Gunarathne, appearing for the accused, filed a bail application in court.

Senior State Counsel Janaka Bandara appearing on behalf of the Attorney-General objected to the bail application.

“The accused will have to seek bail from the Court of Appeal regarding another case filed at the Magistrate’s court. He will not be able to be released since he has been remanded over another case,” he said.

However, after considering the circumstances, the High Court Judge ordered the release of Ajith Prasanna on bail. He was advised to strictly adhere to the bail conditions.

The Colombo High Court Judge warned the accused that if it is proven that he has violated any bail condition, his bail would be cancelled and he would be remanded until the conclusion of the case. The case is to be taken up again on March 4.

The Attorney General had filed an indictment comprising two charges under Section 18 of the Judicature Act against Ajith Prasanna.
