Death penalty for six in murder case

Galle High Court Judge Wasantha Jinadasa yesterday sentenced to death all six suspects who had been indicted for murder of a person in Katudampe, Rathgama, Galle, in 2011.

The convicts were Mawadawilage Nuluksha Madhushan Jayalath, Halu Dinesh Kumara, Yaddehi Nisal Chandana, Dadellage Gayan Sampath, Deneththi Anura Priyantha and Agampodi Indika Prasad.

They had been charged with the murder of a 30-year-old father of two identified as Dehigahage Gaya Chaminda and causing injuries to another person named Kasthuri Elson using iron clubs, on January 29, 2011. The prosecution had submitted to court that two children had quarrelled in front of the slain person’s residence around 9.30 pm on the day of the crime following which he had come out of the house and advised them to stop the squabble. Thereafter the accused who arrived in a three-wheeler had murdered him while also causing injuries to his grandfather using iron clubs, the prosecution had submitted.

In proclamation of the order, the High Court Judge stated that the prosecution had satisfactorily proved that the accused had committed the crime and the same fact had been established according to the report of the Judicial Medical Officer. Attorneys Shrimal Wijesekara and Kasun Gunaratha appeared for the first, third and fourth respondents while state appointed lawyers Chintha Jeewanthi Athukorala and Pinipa Prasadini looked after the interests of the second, fifth and sixth respondents. Sergeant Thisarasena of Rathgama Police prosecuted.
