Avant Garde Chairman refused bail, re-remanded

Travel ban on Palitha Fernando, ship’s captain remain:

The bail application filed by Avant-Garde Maritime Services chairman Nissanka Yapa Senadhipathi named as an accused in the Avant Garde floating armoury case, was yesterday rejected and he was ordered to be re-remanded till December 3 by the Colombo High Court Trial-at-Bar.

Senadhipathi had been receiving treatment at Singapore and he was arrested at the Bandaranaike International Airport (BIA) on arrival by the CID over the case filed pertaining to the Avant Garde High Seas Arms Trafficking.

He was produced before the Colombo High Court Trial-at-Bar and bench ordered to remand Senadhipathi till November 8. Senadhipathi was yesterday produced before court.

When the case came up before the Colombo High Court Trial-at-Bar bench comprising High Court Judges Adithya Patabendige, Dhammika Ganepola and Manjula Thilakarathne, President’s Counsel Gamini Marapana who appeared for Senadhipathi made a lengthy submission before court on regarding granting bail to Senadhipathi.

Delivering the order Colombo High Court Trial-at-Bar observed that after the order given at the last hearing, a significant point had not been raised that warrants granting bail to Senadhipathi.

Colombo High Court Trial-at-Bar consensually ordered to reject the bail application and re-remanded Senadhipathi till December 3.

The case will be taken up again on that date.

Meanwhile, the defence moved court to release travel ban which imposed against third accused in the case, former Rakna Lanka Chairman, retired Major General Palitha Fernando and tenth accused in the case, the captain of ‘MV Avant Garde’, Ukrainian Gennadiy Gavrylov.

That request for lifting travel ban was also rejected by the Colombo Special High Court Trial-at-Bar.
