Museum case against Gota put off for January 9 after SC order

The case against former Defence Ministry Secretary Gotabaya Rajapaksa and six others over an allegation that the D.A. Rajapaksa Museum and Memorial in Medamulana was built using Rs.33.9 million in public funds was yesterday put off for January 9, 2020, by the Colombo Permanent High Court Trial-at-Bar. Deputy Solicitor General Dileepa Peiris appearing for the Attorney General informed Court that the Supreme Court had issued an interim order directing the Permanent High Court Trial-at-Bar not to record evidence in this case until December 20 and that the Supreme Court was to hear this appeal on December 10.

Following the Supreme Court’s interim order., the Trial-at-Bar bench comprising High Court Judges Sampath Abeykoon (President), Sampath Wijeratne and Champa Janaki Rajaratne fixed the case to be taken up as calling date on January 9. Two witnesses in the case were allowed to travel overseas following their request.

On February 11, the Permanent High Court-at-Bar decided to overrule preliminary objections raised by former Defence Secretary Gotabhaya Rajapaksa and six others in connection with the D. A. Rajapaksa Museum case citing that permanent High Court-at-Bar has jurisdiction to hear this case.

Indictments were filed against seven accused, namely, former Defence Ministry Secretary Gotabaya Rajapaksa, and, members of the director board of Land Reclamation and Development Corporation (LRDC) Chairman Prasad Harshan de Silva, Bhadra Udulawathi Kamaladasa, Sudammika Keminda Artigala, Saman Kumara Abraham Galappatti, Devage Mahinda Saliya and Srimathi Mallika Kumari Senadheera under seven counts for allegedly misappropriating LRDC funds of Rs.33.9 million.

DSG Dileepa Peiris appeared for the Attorney General. President’s Counsel Ali Sabry, Anil Silva PC and Nalinda Indatissa PC appeared for the accused.
