SC rejects Gota’s petition against Trial-at-Bar case

Two petitions filed by former Defence Ministry Secretary Gotabaya Rajapaksa challenging the right of the Special High Court Trial-at-Bar to hear the case against him on the use of public funds amounting to Rs. 33.9 million, were rejected by the Supreme Court yesterday.

In this case, Rajapaska and six others are charged with irregularly spending Rs. 33.9 million in public funds to build the D. A. Rajapaksa memorial.

The petitions were taken up for consideration before a five-judge bench comprising Supreme Court Justices Sisira de Abrew, Priyantha Jayawardena, Prasanna Jayawardena, Wijith Malalgoda and L.T.B. Dehideniya.The petitions were rejected on a majority decision of the bench.The Attorney General had filed indictments against former Defence Ministry Secretary Gotabaya Rajapaksa, and members of the director board of the Land Reclamation and Development Corporation (LRDC) under seven counts for allegedly misappropriating LRDC funds totalling Rs.33.9 million. Deputy Solicitor General Viraj Dayaratne appeared for the Attorney General.

President’s Counsel Ali Sabry PC appeared for accused-appellants.
