Kantale sugar factory bribery case to be taken up today

The bribery case filed against President’s former Chief of Staff Kusumdasa Mahanama and former State Timber Corporation (STC) Chairman Piyadasa Dissanayaka will be taken up today by the Permanent High Court Trial-at-Bar, for examination of witness statements.

The court was informed yesterday that several charges were amended in the indictment and a revised indictment was served to the court and the defence by the Commission to Investigate Allegations of Bribery or Corruption (CIABOC), which has filed the case.

The defence counsel told court yesterday that they needed time to study the revised charges against their clients and accordingly, the Permanent High Court Trial-at-Bar postponed the case for today (10).

The complainant and the key witness in the case, Indian businessman K.P. Nagaraja also appeared before the court to give evidence and the court ordered him to produce his two mobile phones which included the conversations in connection with the alleged bribe, before the court today. The accused are charged with allegedly soliciting a bribe of Rs. 540 million and accepting another Rs. 20 million from an Indian investor who wished to acquire a section of the Kantale sugar factory.

The CAIBOC Director General had filed indictments against the two accused under 24 counts for allegedly committing offences under Sections 19(b), 19(c), 25(2) and 25(3) of the Bribery Act. The two accused were arrested in the car park of a luxury hotel in Colombo, on May 3, 2018, by CIABOC officers while accepting the bribe of Rs. 20 million.

The Bribery Commission has named 46 individuals as witnesses and further listed 41 items as production items in the case. Senior State Counsel Janaka Bandara appeared for the Bribery Commission. President’s Counsel Anil de Silva with Rienzie Arsecularatne, PC, appeared for the accused.
