‘Threats’ case against Nethicumara postponed for November

The case filed against businessman Shanil Nethicumara over a charge that he posed death threats to Vijith Wijesuriya, the brother of Anika Wijesuriya, a witness of the Bond Commission inquiry, was yesterday postponed for November 9 by the Colombo High Court.

Senior State Counsel Lakmini Girihagama appearing on behalf of the Attorney General requested the court to set a date for hearing the case and issuing summons to prosecution witnesses.

When the case was taken up yesterday, Colombo High Court Judge Shashi Mahendran ordered the case to be heard on November 8 and three prosecution witnesses including Anika Wijesuriya, who has been named as a key witness in the case, and her brother, to appear in court on the next date.

The Attorney General had filed indictments against businessman Shanil Neththicumara over a charge that he posed death threats to Vijith Wijesuriya, the brother of Anika Wijesuriya, a witness of Bond Commission inquiry.

On a previous occasion, defence counsel moved court to release his client’s passport as Neththicumara expected to travel to Dubai as an official of Ceylon Electricity Board to participate in the 24th World Energy Council to be held between September 9 and 12. However, Senior State Counsel Girihagama appearing on behalf of Attorney General said court had imposed a travel ban on the accused last July and raised objections questioning as to how an individual who had been indicted in the High Court could serve in a government institution.

She informed court that a person with an indictment cannot be enrolled in government employment and is not entitled to a salary from the Consolidated Fund. When the motion was later called before the High Court, the defence counsel appearing for the defendant informed the court that Neththicumara’s father has undergone emergency surgery and therefore he could not travel overseas.

Accordingly, he requested the court to allow the motion to be withdrawn and the High Court Judge granted him permission to do so.

Neththikumara was a former private secretary to several ministers and is the brother-in-law of Narada Dissanayake, the son of former Minister and Parliamentarian S.B. Dissanayake.

The Colombo High Court had served indictments on Shanil Nethicumara over this case and the accused is currently on bail.
