HC revokes warrants issued on Senadhipathi and Palitha Fernando

The Colombo High Court yesterday ordered to revoke the warrants which had been issued for the arrest Avant-Garde Maritime Services (Pvt) Ltd Chairman and retired Army Major Nissanka Senadhipathi and retired Major General Palitha Fernando for their failure to appear before court over a bribery case.

When the case came up before Colombo High Court Judge Shashi Mahendran, two accused were not present in court but they were represented by defence counsel.

Submitting medical reports in court regarding the health condition of Nissanka Senadhipathi, President’s Counsel Gamini Marapana with Navin Marapana PC informed Court that their client was currently receiving medical treatment at a hospital in Singapore. Defence counsel told Court that Nissanka Senadhipathi has undergone a surgery on his left arm and two more surgeries to be performed in the future. The defence counsel moved Court to revoke the warrant issued against Senadhipathi since he has a right receive medical treatment from anywhere in the world. Mr. Marapana further submitted to Court that that Palitha Fernando was in remand custody over another ongoing case at Galle Magistrate’s court.

However, Senior State Counsel Janaka Bandara appearing for the Attorney General moved Court to re-issue warrants for the arrest of the accused since the authenticity of the medical reports to be ascertained.

Taking into consideration facts, High Court Judge Shashi Mahendran decided to revoke the warrant issued on Nissanka Senadhipathi and directed the defence to produce medical reports certified by High Commission of Sri Lanka in Singapore.

Meanwhile, High Court issued an order directing the prison authorities produce Palitha Fernando in Court on September 4.

On August 02, the Colombo High Court issued warrants for the arrest of two accused for their failure to appear before Court.

The Bribery Commission had filed indictments against Avant-Garde Maritime Services (Pvt) Ltd Chairman Senadhipathi and Fernando for involvement in an act of bribery amounting to Rs.35.5 million regarding the Avant-Garde floating armory operation.
