House Leader withdraws Electricity (Amendment) Bill

AG advises ‘inconsistency’:
Fresh Bill to be brought with amendments:

Parliament sittings were adjourned early yesterday after Leader of the House and Public Enterprise, Kandyan Heritage and Kandy Development Minister Lakshman Kiriella withdrew

the Sri Lanka Electricity (Amendment) Bill.

The Bill was in the Order Paper for its second reading. However Minister Kiriella said that he withdrew the Bill as the Attorney General had advised that the Bill was inconsistent with

Constitution. He added that a fresh Bill will be presented in due course with amendments.

Minister Kiriella further stated that this Government would not do anything against the Constitution. It was only in the morning yesterday that the Attorney General had advised the Government that the Bill was inconsistent with the Constitution. In this light, the government decided to withdraw the Bill in the evening although it was included in the Order Paper on a decision at the Party Leaders’ meeting.

He made these observations yesterday following the Opposition Leader, Mahinda Rajapaksa, who said that the Bill was inconsistent with the Constitution, moving a point of order following the Notice of motions.

Minister Kiriella said that he was to withdraw the Bill but the Opposition Leader spoke moving a point of order. The Opposition Leader, moving the point of order, said that the Attorney General had informed that the Bill was inconsistent with the Constitution.

The Engineers’ Association of the Ceylon Electricity Board had objected to this Bill. The Bill vests excessive power in the subject Minister even above the Public Utilities Commission. Hence it provides a bad precedence.

Following the withdrawal, Parliament was adjourned until 1 pm today.
