Anticipatory bail petition dismissed

Colombo Fort Magistrate Ranga Dissanayake yesterday rejected the anticipatory bail application filed by National Police Commission (NPC) Secretary Saman Dissanayake.

Dissanayake had filed an anticipatory bail application on July 8 seeking an order to release him on bail if he was arrested over the Avant Garde illegal floating armory case.

When the matter was taken up before court, the Magistrate announced that there is no jurisdiction to grant bail over cases charged under the Fire Arms Ordnance.

The Magistrate further observed that the alleged offence did not take place in the area which comes under court jurisdiction

On July 5, the Attorney General had instructed the acting Inspector General of Police to produce Nissanka Senadhipathi and seven others before a relevant Court in connection with the offences they had allegedly committed under the Fire Arms Ordnance, the Explosives Act and the Penal Code in the Avant Garde Maritime Services’ floating armory case.

The anticipatory bail application had been filed following the Attorney General’s instructions on the Acting Police Chief to arrest Saman Dissanayake along with seven others over this case.
