Case against Gota, seven others postponed

A corruption case filed against former Defence Secretary Gotabaya Rajapaksa and seven others for allegedly causing a Rs.11.4 billion unlawful loss to the government when giving permission to Avant-Garde Maritime Services (Pvt) Ltd to operate a floating armory was yesterday postponed till September 20 by Colombo Chief Magistrate Lanka Jayaratne.

President’s Counsel Ali Sabry appearing on behalf of former Defence Secretary Gotabaya Rajapaksa yesterday informed the court that the Court of Appeal had issued an Interim Order staying the Colombo Chief Magistrate’s Court proceedings pertaining to the case until July 26 and the court fixed the final order for the same date. When the matter was taken up before the court, the former Defence Secretary Gotabaya Rajapaksa and Avant Garde Chairman Major Nissanka Senadhipathi were not present in Court.

Counsel Ali Sabry further stated that his client Gotabaya Rajapaksa is currently in Singapore for medical treatment and submitted his medical reports before the court.

Attorney-at-law Harith Hettiarachchi appearing on behalf of the Avant Garde Chairman Major Nissanka Senadhipathi stated that his client had gone abroad for medical treatments.

The Magistrate observed that the court had received a letter by registered post on July 7 from Nissanka Senadhipathi.

He had mentioned in his letter that he expects to go abroad for medical treatment, the Magistrate further observed.

The Bribery Commission alleged that the accused had given permission to Avant-Garde Maritime Services (Pvt) Ltd to operate a floating armoury between August 7, 2012 and January 8, 2015 in violation of laws by providing unlawful income to this private company, amounting to Rs.11.4 billion.

The Commission to Investigate Allegations of Bribery or Corruption had filed this case against the eight accused under Section 70 of the Bribery Act.
