AG directs acting IGP to locate three witnesses in Trinco killing case

Attorney General Dappula de Livera has directed the Acting IGP C.D. Wickramaratna to take necessary steps to locate the whereabouts of three witnesses in connection with the killing of five students in Trincomalee in 2006.

On July 3, the Trincomalee Chief Magistrate made an order discharging 13 suspects in the non-summary inquiry on the basis that the available evidence led in that inquiry did not make out a prima facie case against the suspects. The Coordinating Officer to the Attorney General, State Counsel Nishara Jayaratne told the Daily News that evidence of two surviving persons of the incident and one of the parents of a deceased student, Dr. K. Manoharan, could not be led as the CID was unable to locate the whereabouts of the said witnesses.

The CID in this case reported to court that the crucial witnesses were not at their local addresses and that they were reportedly abroad. However, they were unable to confirm this fact and obtain foreign addresses of the witnesses concerned for the purpose of serving summons on them.

As a consequence of the failure to locate the witnesses, the prosecution had to move for several adjournments in the non-summary inquiry.

This period was extended to over five years. Accordingly, the accused in the non-summary inquiry were discharged from the case.
