CA affirms Kudu Shiyam’s death sentence

A Court of Appeal two-judge-bench yesterday unanimously affirmed the conviction and death sentence imposed on millionaire drug king-pin, Mohammed Samoon Mohammed Shiyam alias Kudu Shiyam for possessing nine killogrammes of pure heroin in 2003.

Justice Kumuduni Wickremasinghe and Justice Janak de Silva also affirmed the life imprisonment imposed on Murshida Shiyam, the wife of Kudu Shiyam over the same offence.

The Court of Appeal made this order pursuant to an appeal petition filed by two accused challenging the Colombo High Court’s order dated December 14, 2007. Through this appeal, accused-appellants sought the jurisdiction of Court of Appeal to review and set aside their conviction and the death sentence imposed by High Court.

Mohammed Shiyam was arrested by the Police Narcotics Bureau (PNB) with bags of heroin weighing 23 kilogrammes at his residence at Ward Place in Colombo on November 28, 2003. Colombo High Court sentenced Shiyam to death while Shiyams’s wife Murshida Shiyam was sentenced to life imprisonment. However, the Government Analyst’s Department revealed that it contained nine kilograms of pure heroin.
