Journalist files FR to prevent imminent arrest

Freelance Journalist Kusal Perera has filed a fundamental rights petition in the Supreme Court seeking an interim order restraining Organized Crime Prevention Division from arresting him in respect of the article published in an English newspaper.

Filing this petition through Attorney-at-law Manjula Balasuriya, journalist Kusal Perera stated that he has come to know that a B Report has been filed in the Colombo Chief Magistrate’s Court by the Organized Crime and Legal Division and several orders have been obtained from the Magistrate in respect of an article written by him on May 17, 2019.

The Petitioner states that while he is unaware of the exact contents of the B Report, he has been made aware that the Organized Crime Prevention Division is attempting to arrest him alleging that he has committed an offence punishable under Section 3 of the International Covenant on Civil and Political Rights (ICCPR) Act.

The petitioner further sought a declaration that the respondents or the state has infringed or are in imminent infringement of the Fundamental Rights of the Petitioner as guaranteed by Articles 10, 12(1), 13(1), 13(2), 14(1)(a) and 14(1)(g) of the Constitution.
