A Fundamental Rights petition was filed in the Supreme Court seeking an order directing the government to pay Rs.10 million as compensation to victims who died and Rs.50 million for the injured in the Easter Sunday bomb blasts.
The petition was filed by P.K.A.D. Sunil Perera, a resident of Ratmalana through counsel Lakshan Dias and counsel Senaka Perera naming President Maithripala Sirisena, Prime Minister Ranil Wickremesinghe, former Defence Secretary Hemasiri Fernando, Defence Secretary General Shantha Kottegoda, Inspector General Pujith Jayasundara, acting Inspector General C.D. Wickramaratne and several others as respondents.
The petitioner is also seeking a declaration that the action of the Respondents have violated the Fundamental Rights guaranteed under the Article of 12(1) and 14 (1) (a), (c) of the constitution.
The petitioner states that he filed this case as a public interest litigation case as he is concerned about the people’s rights which has been violated due to the government’s as failure in preventing the occurrence of the Easter Sunday Attack on April 21 in six locations.
The petitioner states that he is a victim who lost his wife, a mother of a girl child and an unborn child on May 26, 2008 as a result of the bomb blast which occurred at the Dehiwala Railway Station due to the irresponsibility of the officers who are bound to protect the nation.
The petitioner states that according to the assumption both the Easter Attack and the Dehiwala Bombing occurred due to the failure of the authorities and decision makers.
The petitioner states that he is compelled to file this case to avert such in security and intelligence mishaps in future.
Petitioner states that the victims who lost their loved ones during the Easter attack also facing the same situation which was faced by the petitioner in 2008 due to the state failure to act upon the information received by them and neglected to take it in proper magnitude.
The petitioner states that over 250 people were killed including three police officers and at least 500 were injured in the said bombings due to the negligence of the respondents.
