Kodituwakku’s petition against SC judges dismissed

 

A petition filed by civil activist Nagananda Kodituwakku claiming Rs.100 million each as damages from the judges who sat on the Supreme Court bench to prevent Kodituwakku from practicing as a lawyer for a period of three years was yesterday dismissed by the Colombo High Court.

Taking into consideration the preliminary objections raised by the Attorney General, Colombo High Court Judge Gihan Kulatunga decided to dismiss this petition in-limine.

The petitioner Kodituwakku had named former Chief Justice Nalin Perera, Justice Sisira de Abrew and Justice Prasanna Jayawardena, Justice Vijith Malalgoda and Attorney General as respondents.

Additional Solicitor General Farzana Jameel PC appearing for the Attorney General raised preliminary objections citing the petitioner cannot invoke the High Court’s jurisdiction through this kind application. She further stated that Nagananda Kodituwakku was found guilty following an inquiry for breaching Supreme Court rules.

On last March 18, the Supreme Court issued an order debarring Attorney-at-Law Nagananda Kodituwakku from practicing as a lawyer for a period of three years. The Supreme Court three-judge-bench comprising Chief Justice Nalin Perera, Justice Sisira de Abrew and Justice Prasanna Jayawardena delivered this ruling pursuant to a complaint made by Supreme Court Justice Vijith K. Malalgoda concerning improper, insulting, intolerable, unbecoming and contemptuous behaviour on the Court of Appeal by respondent Nagananda Kodituwakku.
