Wimal files appeal notice over Neththa Venuwata Aththa

National Freedom Front Leader Wimal Weerawansa yesterday filed an appeal notice in Colombo Commercial High Court regarding the judgement delivered over the book titled Neththa Venuwata Aththa.

Filing this notice through counsel Kapila Gamage, parliamentarian Weerawansa informed that he is expecting to file an appeal in Supreme Court challenging the Commercial High Court judgment dated January 11, 2019.

Through his appeal, MP Weerawansa is expecting to seek an order to set aside the Commercial High Court judgment which ordered him to pay a sum of one million rupees as damages to JVP General Secretary Tilvin Silva. In his judgment, Commercial High Court Judge Ruwan Fernando ruled that several articles contained in the concerned book have violated the publication rights, economical rights and moral rights coming under the Intellectual Property Act No.36 of 2003.

The Commercial High Court further issued an order restraining Wimal Weerawansa from printing, publishing, selling and distribution of the book titled Neththa Wenuwata Aththa.

The lawsuit filed by plaintiff Tilvin Silva for violating the provisions of the Intellectual Property Act by publishing the book had cited its author Wimal Weerawansa as the defendant.

The plaintiff alleged that the book by Wimal Weerawansa was nothing but JVP political opinion that was submitted before the JVP Central Committee.
