Case against Hirunika fixed for March 12

 

The case against Colombo Parliamentarian Hirunika Premachandra for her alleged involvement in the abduction of a youth using a Defender, was yesterday fixed for trial by the Colombo High Court. Accordingly, the case was fixed for trial on March 12 and 13 by High Court Judge Shashi Mahendran.

The second to seventh witnesses in the case were noticed to appear in courts on next trial date.

At a previous occasion, except for Hirunika Premachandra and a schoolboy, seven other accused who pleaded guilty to their involvement in the abduction, had been given a suspended prison sentence by the Colombo High Court.

The High Court sentenced the seven accused to two years in prison suspended for 12 years.

Apart from the suspended sentence, the High Court ordered the seven accused to pay a compensation of Rs.285,000 to the victim. The Court further ordered five accused to pay a fine of Rs.33,000 each for other charges.

The eighth accused, an 18-year-old schoolboy, was ordered to be released on a bond of Rs.100,000 in accordance with Section 303 of the Criminal Procedure Code, taking his age into consideration.

Five of the seven accused paid compensation to the victim yesterday.

The accused; Kelum Niranjana, Kasun Malinda, Ruwan Pushpakumara, Mohammed Rizwan, Pasindu Sanjeewa, P.S. Abeysiriwardena, Sanjeewa Kumara and Jeganadacal pleaded guilty to charges including abduction, aiding and abetting the abduction, and unlawful assembly.

Apart from the abduction charges, the accused have been charged with 29 counts by the Attorney-General, including threatening, assaulting and intimidating the victim Amila Priyankara after abducting him in Dematagoda.

The complainant, Amila Priyankara, alleged that he was abducted and assaulted by a group of people who arrived in a black Defender to Dematagoda on December 21, 2015.

Senior State Counsel Janaka Bandara appeared on behalf of the Attorney-General. Counsel Anura Seneviratne and Ajith Pathirana appeared on behalf of the Hirunika Premachandra.

The Colombo High Court has decided to hear the case against MP Hirunika Premachandra on the 12th and 13th of March, 2019.

The case against Colombo district Parliamentarian Hirunika Premachandra for her alleged involvement in the abduction of a youth using a Defender . At an earlier occasion the seven suspects plead guilty in the case; the eighth suspect, Hirunika Premachandra plead not guilty.
The seven are alleged to have masterminded and conducted the abduction of a 34-year-old youth in Dematogoda in December 2016 using a Land Rover belonging to Premachandra.
Nine including Premachandra were charged over the abduction while the Colombo District MP was arrested on January 9, 2016 and subsequently granted bail by the court.
On November 06, the suspects excluding UNP MP Hirunika Premachandra admitted before the Colombo High Court to abducting the youth and were sentenced to 2 years rigorous imprisonment suspended for 12 years by the Colombo High Court.
