Galle HC suspends recruits to Southern GMAS

Galle High Court Judge Manjula Thilakaratna issued an interim injunction order suspending the recruitment of personnel to fill the existing Supra Grade vacancies in the Southern Provincial Government Management Assistant Service (GMAS) based on the merits of the competitive examination held in 2016.

The High Court Judge, who postponed the hearing for October 31, ordered the respondents to file their objections on that date.

The High Court Judge issued the order hearing a petition for a Writ of Mandamus pleading the suspension of the alleged illegal decision of the Southern Province Governor’s Secretary to recruit personnel to fill the existing Supra Grade vacancies in the Southern Provincial Government Management Assistant Service.

This was based on the merits of the competitive examination held in 2016 for the recruitment of officers to the grade despite the fact that new applications were called to hold the examination for 2018.

Diyunage Prasanna of Bataganwila, Galle, Metaramba Kanatta Gamage Nalina of Uluwitike, Galle and Gothatuwe Parana Widanalage Hemantha of Gothatuwa, Baddegama had filed the application for the Writ of Mandamus.

Southern Province Public Services Commission at the Galle District Secretariat, Southern Province Public Service Commission’s Secretary, Southern Province Governor’s Secretary, Southern Provincial Council Secretary, W. H. Nandani of the Southern Province Ayurveda Department, M. Sandya of Tissamaharama Base Hospital, K. K. Jayanthi of Matara, District Engineers’ Services Office, A. W. P. Malkanthi of the Matara Cooperative Development Commissioner’s Office and G. H. S. Dayawathi of the Southern Province Chief Secretariat had been cited as respondent.

The first respondent is the appointing authority while the second respondent is the secretary of the commission. The fourth respondent is the appointing authority of the Provincial Council subject to the approval of the first respondent.

The third respondent is the secretary to the Southern Province Governor. The fifth to ninth respondents are the prospective appointees whose appointments are challenged by the petition.

The petitioners in their submissions stated that they were Grade 3 officers of the permanent cadre.
