Former Colombo Judicial Medical Officer (JMO) and SAITM Vice Chancellor Dr. Ananda Samarasekera yesterday filed a Fundamental Rights application before the Supreme Court seeking an order preventing the IGP and other officials from arresting him over the missing body parts of ruggerite Wasim Thajudeen. The petitioner has also pleaded court to issue an order to the investigators to produce the reports of the investigations conducted by them so far into the Thajudeen’s murder.
Thirteen officials including Health Ministry Secretary Anura Jayawickrema, Health Services Director General Dr. Palitha Mahipala, Investigation Committee Chairman Dr. Lakshman C. Somathunga and IGP Pujith Jayasundera have been cited as respondents in the petition.
The Petitioner retired as Colombo Chief Medical Officer in 2013 after completing 30 years in the medical profession and a body of an unidentified man was brought to his institute for his examination on May 17, 2012.
Dr.Samarasekera in his petition has cited that this death was due to an accident followed by fire and an order was issued by the Colombo Additional Magistrate to conduct a post mortem.
The former Colombo JMO said that he conducted the post mortem with the assistance of two additional jkudiciapl Medical Officials and came to know that the deceased was under the influence of liquor from a policeman before the accident took place.
The Petitioner cited that several body parts of the deceased were kept in the refrigerator for further investigations as usual and the preliminary investigation report was produced in court on May 17, 2012.
He told court that he received information that court has issued notice on him over this post mortem but neither occation has he received notice from court.
The petitioner cited that he produced an additional report in connection with the death on April 9, 2013. The former Colombo JMO cited that he retired from service on June 3, 2012 and he was not involved in activities with regard to the body parts stored in the refrigerators after his retirement.
He told court that some body parts of Wasim Thajudeen is said to have been misplaced from the refrigerator and authorities pointing fingers at him over the misplacement of body parts.
The petitioner told court that his fundamental rights may be violated, if arrest is made on these charge of alleged misplacement of body parts and pleaded court to issue an order preventing the IGP or his representatives from arresting him.
The petitioner has also prayed court to issue an order to the IGP, Director of Criminal Investigation Department and Officer In Charge of Crimes Investigation branch Chief Inspector Ravindra Wimalasiri to submit charges against in an affidavit.
